Hope and change have finally arrived (well, if you are a lover of powersports). President Obama signed into law, H.R. 2715 on August 12 which reverses the ban on ATV’s, off-road motorcycles and dirt bikes intended for children under the age of 12.
Originally banned under the Consumer Product Safety Improvement Act of 2008 because they contain batteries with lead, H.R. 2715 amends the Act to allow for the exclusion of off-road ATV’s, motorcycles, dirt bikes, and snowmobiles.
Thanks in part to lobbying from millions of OHV enthusiast, and countless organizations and special interest groups including Motorcycle Industry Council, American Motorcycle Association, All-Terrain Vehicle Association (ATVA), H.R. 2715 was introduced by Reps. Mary Bono Mack (R-Calif.) and G.K. Butterfield (D-N.C.).
The full text of the amendment can be found at the Library of Congress website.
The amendment also includes revisions on independent testing, challenges, and exclusions, as well as improving clarity so future invented products can be legalized if the lead content is typically inaccessible to ingestion through normal or expected use.
